OfReg has taken action to cease fuelling operations at Jack’s Esso II in Northside effective today, 14 November 2023, due to the operator's failure to comply with a remedial notice request. The request was issued to obtain essential data required for the regulator's analysis of the environmental conditions at the site. The information requested by OfReg would show if there is any leakage in the tanks which could adversely affect the environment.
Despite prior communication and the issuance of a remedial notice, the operator of Jack’s Esso II has not provided the necessary data crucial for the regulator's environmental assessment.
The decision to cease fuelling operations was made under OfReg’s mandatory responsibility and commitment to uphold environmental regulations and safeguard public health.
As the regulator for the fuels sector, OfReg has a legal obligation and duty of care to hold operators to account for complying with the terms of their licences and in this case, protecting the environment and safeguarding public health.
OfReg is committed to upholding environmental regulations and this case also highlights the necessity for all operators to comply with regulatory requests promptly. OfReg is actively working with the operator to resolve the compliance issues and is working to resume fuelling operations at Jack’s Esso II as soon as possible. The site will remain closed for the sale of fuels until further notice.
